Honestly, I personally do not believe that Avril has plagiarized, because doesn’t it say that you are allowed to take 30 seconds or 10% which ever is less? She did not take either 30 seconds or 10 %, but I can see where they said that she took the heart and soul out of the other song. I know I have never heard of the Rubinoos, but I do not know about other people. The catch phrase everybody knows from her song “Girlfriend” is “hey, hey, you, you, I don’t like your girlfriend.” That is taking the heart and soul out of the song “I Wanna Be Your Boyfriend," by the Rubinoos, which is “hey, hey, you, you, I wanna be your boyfriend.”
Though, it also states that whatever you take that is less than 30 seconds or 10%, you can not make anymore money than the original owner did, and Avril Lavigne did make more money especially on that one catch phrase which brought everybody to buy the c.d. Though the Ramones have a song similar to theirs why would they not also go after them? Or why wouldn’t they go after the Rolling stones for their remake of the song? Both sound pretty similar, but why just go after Avril Lavigne? Would it because she got the most money out of the portion of the song that was taken? So they thought they would get more than the other two.
